The soon to be launched Microsoft Surface has the same general curved design as the iPad which also is the case with Samsung  tablets, unlike Samsung, Microsoft will not get sued over this, this is perfectly legal for Microsoft. Apple has licensed some of its design patents to Microsoft, under the condition of an “anti-cloning agreement” that prevents Microsoft from releasing clones of iPhone and iPad.

Reuter reported that this information came from Apple’s patent licensing director Boris Tekser, who said in court on Monday that Apple offers many patents for licensing, with the exception of a few patents that cover iOS’s “unique user experience” which Apple is zealously protective of.

“There was no right with respect to these design patents to build clones of any type,” Teksler said
